DMCA Copyright Policy

VidGen respects the intellectual property rights of others and is committed to complying with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws. We respond promptly to valid copyright infringement claims and will remove infringing content in accordance with this policy.


Our Commitment to Copyright Protection

  • VidGen does not permit copyright-infringing content on its platform
  • We will remove or disable access to infringing content upon receipt of a valid DMCA notice
  • Repeat copyright infringers will have their accounts terminated

User Responsibility

All users are responsible for ensuring that content they upload to VidGen:

  • Is owned by them or is properly licensed for the intended use
  • Does not infringe on the copyrights, trademarks, or other intellectual property rights of any third party
  • Complies with the licensing terms of any third-party content used

  5. Accuracy and authority statement — A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner

Response Timeline

Upon receipt of a valid DMCA notice:

  • Acknowledgment: We aim to acknowledge notices promptly
  • Content removal or disabling: We typically remove or disable access to content within a reasonable timeframe after verifying a valid notice
  • User notification: We generally notify the affected account holder after removal or disabling

Counter-Notification Process

If you believe your content was removed or disabled in error, you have the right to submit a counter-notification.

Requirements for Counter-Notice

Your counter-notification must include:

  1. Identification of removed content — A description of the content that was removed and its previous location on VidGen
  2. Your contact information — Your full name, mailing address, telephone number, and email address
  3. Good faith statement — A statement under penalty of perjury that you believe the content was removed by mistake or misidentification
  4. Consent to jurisdiction — A statement that you consent to the jurisdiction of a court of competent jurisdiction in the primary place of operation of VidGen, and that you will accept service of process from the party that filed the original DMCA notice
  5. Signature — Your physical or electronic signature

Counter-Notice Timeline

  • Counter-notifications are generally reviewed within a reasonable timeframe, typically within several business days
  • If valid, removed content may be reinstated after the required waiting period
  • The original complaining party may seek a court order to prevent reinstatement

Repeat Infringer Policy

VidGen enforces a repeat infringer policy in accordance with the DMCA:

  1. First violation: Warning and immediate content removal
  2. Second violation: Temporary account suspension (7 to 30 days)
  3. Third violation: Permanent account termination

Accounts terminated for repeat copyright infringement are banned from creating new accounts.


False DMCA Claims

Filing a false DMCA notice is a serious matter. Knowingly misrepresenting that content is infringing may expose you to civil liability under 17 U.S.C. § 512(f), including damages and attorneys' fees. We strongly encourage you to consult with a qualified attorney before submitting a DMCA notice if you are uncertain about your rights.


Proactive Content Monitoring

VidGen employs automated systems to detect potentially infringing content and regularly reviews flagged material. Users may also report suspected copyright infringement through our platform or by emailing [email protected].
